What are the NIS2 authority communication obligations?

NIS2-regulated entities have three main obligations towards authorities: 1) Registration obligation (BSI registration within three months of becoming subject to NIS2, in Germany by March 6, 2026), 2) Incident reporting obligation (warn about significant incidents within 24 hours, detailed notification within 72 hours, final report within 30 days), 3) Ongoing cooperation obligation (provide information on request, allow supervisory inspections).

How do you register with the BSI for NIS2?

BSI registration is a two-step process: Step 1: Register with Mein Unternehmenskonto (MUK) using ELSTER certificate (the German state digital identity service). Company data automatically transfers to the BSI portal. Step 2, BSI portal registration: sector classification, EU member states of service delivery, company size metrics, KRITIS institution IDs if applicable, and public IP address ranges. The portal opened January 6, 2026.

Which authorities are responsible for NIS2 supervision in Germany?

The BSI (Federal Office for Information Security) is the central NIS2 supervisory authority in Germany. However, sector-specific regulators may have primary responsibility: BaFin for financial institutions (which fall under DORA), the Federal Network Agency (Bundesnetzagentur) for energy and telecom companies, the Federal Railway Office for rail transport. NIS2 entities should clarify which authority has primary jurisdiction over their activities.

What must be reported to the BSI and how often?

Reportable are significant security incidents (substantial disruption of services or potentially significant impacts). The three-stage reporting process: Early warning within 24 hours (basic incident information), Incident Notification within 72 hours (initial assessment, indicators of compromise, preliminary measures), Final Report within 30 days (complete analysis, root causes, impacts, remediation). Registration data changes must be reported without delay, at the latest within two weeks.

What are the consequences of missing NIS2 registration?

Missing or late BSI registration constitutes a regulatory violation under NIS2UmsuCG. Fines: for essential entities up to EUR 10 million or 2% of global annual turnover, for important entities up to EUR 7 million or 1.4% annual turnover. For essential entities, the BSI can hold management bodies personally liable and temporarily prohibit individuals from exercising management functions. Under Section 33 BSIG the registration deadline is three months from the date on which an entity first or newly falls within the scope of NIS2. For entities already in scope when the NIS2UmsuCG entered into force on 6 December 2025, that deadline fell on 6 March 2026. Entities that come into scope later have their own three-month deadline.

NIS2 authority notification vs. GDPR authority notification: what is the difference?

Both reporting obligations can be triggered simultaneously by a cyberattack: GDPR Art. 33 requires notification of personal data breaches to the data protection authority within 72 hours. NIS2 requires reporting of significant security incidents to the BSI with a 24-hour early warning. In an attack affecting personal data: both processes run in parallel but to different authorities. Integrated incident management processes are essential to avoid missed deadlines.
