Article 4 of the EU AI Act has been in effect since February 2, 2025. It obliges every company that operates or uses AI systems to ensure “sufficient AI competence” among its staff. From August 2026, the regulations for high-risk AI will come into effect - including documentation requirements, risk analyzes and conformity assessments. Anyone who cannot deliver then risks fines of up to 35 million euros or 7% of their global annual turnover.

Most companies are already using AI: in customer service, recruiting, lending, and production control. But who coordinates compliance? Who ensures that each individual AI system is documented, evaluated and monitored? Who reports risks to the board before they escalate?

The answer is a role that barely existed five years ago: the AI officer. 85% of managers now classify AI as business-critical - according to a study by the personnel consultancy Kienbaum. But business critical without governance is a risk, not a benefit.

This article shows what an AI officer actually does, which companies need one, what models there are and how the implementation works in practice.

What is an AI Officer? Definition and delimitation

The term “AI Officer” describes a role at the interface of technology, law and business strategy. It's not about the person training machine learning models. And not about the lawyer who checks contracts. The AI Officer combines governance, compliance and strategic control in one position.

AI Officer, AI Officer, Chief AI Officer — what’s the difference?

The terms are often used synonymously, but describe different forms:

Chief AI Officer (CAIO):A C-level role. The CAIO sits on the management board and is responsible for the AI strategy of the entire company. He decides on investments, partnerships and strategic direction. Today, this role can be found primarily in corporations and tech companies - Google, Microsoft and Meta have long since established it.

AI Officer / AI Representative:The operational variant. The AI Officer implements the AI strategy, develops governance frameworks, ensures compliance and coordinates stakeholders. He doesn't have to be on the board, but he does need direct access to it. In many medium-sized companies, this role is the more pragmatic entry point.

Data science teams:Purely technically oriented. You build models, optimize algorithms, and work with data. Governance, compliance and risk management are not part of their core mandate.

The key point: an AI officer is not a technician with compliance tasks. He is a governance specialist with technical understanding. That's a fundamental difference — and the reason why this role can't simply be added to an existing position.

EU AI Act: Why AI competence is now mandatory

The [EU AI Act](https://artificialintelligenceact.eu/de/) is the world's first comprehensive AI regulation. His demands unfold in stages - and the clock is ticking.

Article 4 — already in force since February 2025:Providers and operators of AI systems must ensure that their personnel have a “sufficient level of AI competence”. That sounds soft, but it's a tough chore. Anyone who cannot demonstrate verifiable training measures is already violating applicable EU law.

High-risk AI — from August 2026:AI systems in areas such as personnel selection, lending, law enforcement or critical infrastructure are subject to stricter requirements. These include:

The sanctions regime is drastic:Up to 35 million euros or 7% of global annual turnover for prohibited AI practices. Up to 15 million euros or 3% for violations of high-risk requirements. Even providing false information to authorities costs up to 7.5 million euros or 1% of sales.

In Germany, BaFin and BSI are further tightening controls. BaFin has already made it clear that AI-based credit decisions fall under the existing MaRisk requirements. The BSI integrates AI risks into its criteria catalogs for critical infrastructures.

Conclusion: Anyone who does not have a structured approach to [AI governance](/ki-governance) will have a massive compliance problem from August 2026.

Specific tasks: What does an AI officer do in everyday life?

The role sounds abstract. It's not your daily work. An AI officer has five core areas of responsibility — each with specific deliverables.

Develop and maintain AI governance

The AI Officer defines the rules for AI in the company. This starts with an AI policy that determines which AI applications are permitted, which approval processes apply and which ethical guidelines must be adhered to.

Specifically, this means:

Conduct risk assessment

This is not a one-time exercise. AI models change over time. A model that was fair at launch may develop discriminatory patterns after six months of drift. The AI Officer therefore implements monitoring mechanisms that check continuously - not just during the initial assessment.

There are also data protection impact assessments (DPIAs) for AI systems that process personal data. Here, the AI officer works closely with the data protection officer - the roles complement each other, but do not overlap.

Ensure compliance

From August 2026, operators of high-risk AI must maintain comprehensive documentation. The AI Officer ensures that:

Coordinate stakeholders

Article 4 of the EU AI Act requires AI competence - not just from the AI officer himself, but from every employee who works with AI systems. The AI Officer develops training programs tailored to different target groups:

Which companies need an AI officer?

The short answer: any company that uses AI. The nuanced answer depends on the industry, the type of AI use and the size of the company.

Highly regulated industries – an AI officer is mandatory here

Financial service providersare under particular pressure. BaFin already expects that AI-supported credit decisions will meet the MaRisk requirements. DORA (Digital Operational Resilience Act) imposes additional requirements on the IT resilience of AI systems. If you don't have an AI officer here, you're playing with the bank license.

Healthcare:AI diagnostics, patient data analysis and automated treatment recommendations fall under the strictest categories of the EU AI Act. Clinics and medical technology companies need someone who understands both AI regulation and medical device regulations.

Automotive:Autonomous driving systems and safety-critical AI applications are, by definition, high-risk AI. The documentation and testing requirements are enormous — impossible to manage without a dedicated governance role.

Companies with high-risk AI — strongly recommended

There are also high-risk applications outside of regulated industries. AI-intensive companies — strategically sensible

Tech companies with their own AI products, e-commerce platforms with recommendation systems and industrial companies with AI-driven automation benefit from an AI officer, even if there is no immediate high-risk classification. The AI officer creates structure here, prevents uncontrolled growth and ensures quality.

Rule of thumb:From 250 employees or with significant use of AI, an AI officer is no longer an option, but an operational necessity.

Internal vs. External: AI Officer models in comparison

The role is defined. The question is: how do you cast them? There are three models — each with clear advantages and disadvantages.

Internal AI Officer

Advantages:Deep understanding of the corporate culture, permanent availability, long-term development of institutional knowledge. An internal AI officer knows the stakeholders, the processes and the political nuances.

Disadvantages:Qualified candidates are extremely rare. The requirement profile — technology, law, governance, communications — is so broad that few people cover it completely. The salaries reflect this: 90,000 to 150,000 euros are realistic for experienced AI officers in Germany, and the trend is rising.

Risk:If you hire the wrong person, you will lose six to twelve months — and then still not have a functioning governance framework.

External AI Officer (vCAIO model)

The "Virtual Chief AI Officer" model follows the logic of the vCISO, which has proven itself in [information security](/information security): An experienced specialist works as an external consultant for the company, typically in a part-time model.

Advantages:Available immediately, brings experience from various industries and companies, more cost-effective than a full-time position. An external AI officer has seen best practices that an internal candidate would have to develop.

Disadvantages:Less proximity to the company in day-to-day business. Only works with a clear internal contact who coordinates operational issues.

Costs:Depending on the scope, between 3,000 and 8,000 euros per month - a fraction of a full-time position with additional costs.

Hybrid model

The most pragmatic solution for many companies: an external AI officer builds the governance framework, trains internal employees and gradually hands over operational responsibility. This creates internal know-how without the company having to manage the entire structure alone.

This model has proven itself in practice - similar to the introduction of information security management systems, where external consultants first create the structures and then hand them over to internal ISBs.

Skills and qualifications: What makes a good AI officer?

An AI officer does not need a computer science degree. But he needs an unusually broad skills profile, which is divided into four areas.

Technical competence

The AI officer must understand AI systems — not at the code level, but at the architecture level. He needs to know how a machine learning model is trained, what bias in training data means, how hallucinations arise in large language models and what technical measures can be taken to counteract them. There is also a basic understanding of data architectures, cloud systems and IT security.

Regulatory know-how

Pure online courses without practical relevance are not enough.

Before the role is filled, it must be clear what the role is supposed to achieve. The assessment includes:

Without a central AI officer, parallel structures emerge: Each department builds its own AI governance, invents its own processes, and makes its own mistakes. Companies with proven AI governance gain trust — from customers, partners and talent. Especially in the B2B environment, evidence of AI governance is increasingly becoming a prerequisite for tenders. Whoever has it sits at the table. Anyone who doesn't have it stays outside.

Is an AI officer required by law?
